MyStringJobs – Terms of Use

These Terms of Use (the "Terms") are a legal agreement between you ("you," "your," or "User") and VY Sports Inc. ("MyStringJobs," "we," "us," or "our") that governs your access to and use of the MyStringJobs website, services, and any related applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

MyStringJobs is a free, cloud‑based platform that enables racket stringers to create and manage stringing work orders, including customer information, racket details, and stringing preferences. All data entered by Users is private to the account but visible to every authorized user within that account.

2. Eligibility & Capacity

We do not impose a minimum age requirement; however, you must have the legal capacity to form a binding contract under the laws that apply to you. If you are a minor where you live, you must obtain consent from a parent or legal guardian before using the Service, and that adult will be responsible for your compliance with these Terms.

3. Account Registration

You must create an account to use most features of the Service. You agree to:

• Provide accurate, current, and complete information during registration;
• Keep your credentials secure and not share them with others; and
• Notify us immediately at [email protected] of any unauthorized use or security breach.

4. Fees & Payments

The Service is provided free of charge. We do not collect or store payment information. If we introduce paid features in the future, we will update these Terms and notify you in advance.

5. User Content & Data

You retain all rights in the information you store through the Service (e.g., company data, customer names, phone numbers, e‑mails, racket specifications, and stringing preferences). By submitting data, you grant MyStringJobs a limited license to host, store, and process that data solely to provide and improve the Service.

No file uploads are supported at this time.

You are solely responsible for ensuring that any personal information you store complies with applicable privacy laws.

6. Privacy

Our separate Privacy Policy explains how we collect, use, and protect personal information. By using the Service, you acknowledge and agree to that Policy.

7. Acceptable Use

You agree not to:

• Misuse, disrupt, or overload the Service;
• Reverse engineer or attempt to derive the source code;
• Use the Service to infringe others' rights or violate any law;
• Bypass or disable security features.

We may suspend or terminate your account at our sole discretion if we believe you are abusing the Service.

8. Third‑Party Services

The Service relies on third‑party providers, including:

• Google Cloud Platform (GCP) for hosting;
• Google reCAPTCHA for bot protection (subject to Google's Privacy Policy and Terms of Service);
• Google Workspace for e‑mail delivery; and
• Mailgun for transactional e‑mail processing.

Your use of those components is governed by the respective providers' terms in addition to ours.

9. Service Availability

The Service is provided "as‑is" and "as‑available." We make no guarantees regarding uptime, availability, or uninterrupted access and may modify, suspend, or discontinue any part of the Service at any time without notice.

10. Termination

You may stop using the Service at any time. We reserve the right to terminate or suspend your account immediately, without prior notice, if we determine—at our sole discretion—that you have violated these Terms or abused the Service. We may delete your data after termination, and we are under no obligation to provide a copy unless required by law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS‑IS," "WITH ALL FAULTS," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR‑FREE OR SECURE, OR THAT DATA STORED WILL BE ACCURATE OR PRESERVED WITHOUT LOSS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VY SPORTS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED CAD 0.

13. Indemnification

You agree to indemnify and hold harmless VY Sports Inc. from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service or violation of these Terms.

14. Changes to These Terms

We may modify these Terms from time to time. Significant changes will be communicated to the e‑mail address associated with your account. Changes take effect on the date specified in the notice. Continued use of the Service after that date constitutes acceptance of the revised Terms.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Québec, Canada, without regard to conflict‑of‑law principles. Any dispute arising out of these Terms or the Service shall be resolved in the courts located in Québec, and you consent to the personal jurisdiction and venue of those courts.

16. Entire Agreement & Severability

These Terms constitute the entire agreement between you and MyStringJobs regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
